Freeclaim Welcomes Accident Claim Text Messages Clampdown

Freeclaim Solicitors have been working with various regulators for a number of years now to provide information on spam text messaging about accident claims to help clampdown on this 'shady' practice. Back in 2010 we warned clients about compensation claim text messages being sent out randomly to millions of mobile phone numbers.

Unfortunately the practice has also spread and now users can be bombarded with debt messages too and complaints about accident claims and debt texts have tripled in last couple of years.

From February the Information Commissioner's Office (ICO) now has the power to fine the companies behind the spam messaging. Simon Entwistle from the ICO commented, "We believe there has been a huge increase towards the end of last year in sending texts to randomly generated numbers...the spammers are not easy to track down. There is a spider's web of organisation that are linked in this..."

It is also hoped that with an impending ban on referral fees or ‘selling' leads and cases on will help prevent the text spamming.

At Freeclaim accident solicitors, we've had many of our clients and staff being targeted with spam text messages. We would warn all mobile phone users who receive such unsolicited accident claims messages to ensure that they never reveal any financial information and to report the message to both your mobile phone network and the ICO's helpline (0303 123 1113).

A quadriplegic motorcyclist is taking action against two schoolgirls seeking more than £300,000 in road accident compensation after he was seriously injured when he swerved to avoid them in a horrific motorbike accident.

Mr. Porter swerved, fell from his bike and then was run over by a van, leaving him paralysed. He claims that the girls were negligent when they stepped off the kerb into moving traffic, causing him to take immediate action to avoid them.

The writ states, "...the defendants suddenly and without warning emerged from between slow moving traffic from the right and established themselves past the white centre line in the claimant's path, unable to proceed through the northbound traffic.

"The claimant immediately engaged his brakes and swerved so as to avoid striking the defendants.
Accident Claims Referral Fees Ban

Freeclaim Solicitors, specialists in road accident and motorbike accident compensation, welcomes the announcement to abolish controversial referral fees for personal injury claims.

Referral fees, often amounting to hundreds of pounds, are paid to insurance companies and claims companies in return for people's accident details. We are hopeful that it will also stop nuisance accident claim texts which many clients believe wrongly are being made by solicitors. Solicitors have a strict code of conduct and are not allowed to cold call clients.

Freeclaim Solicitors are NOT a claims company and we DO NOT buy accident claims - our clients contact us directly. We have long been campaigning to push for a ban on referral fees. Clients should be free to instruct a solicitor of their own choice and we will always advise accident victims to speak directly to a solicitor who is experienced in Personal Injury Law rather than being referred to a solicitor who has simply bid the highest fee.

For independent claims advice after a motorbike accident or other road traffic accident, call Freeclaim Solicitors today on 0800 612 4479.

Following a serious road accident, a motorcyclist has had his compensation claim settled at what is thought to be a five figure sum.

The 39 year old from Bath was driving his motorbike on a dual carriageway when a Saab collided with him when attempting to move to the outside lane without indicating. The motorcyclist suffered serious injuries including a fractured tibia and broken collarbone. The collision occurred at a relatively low speed, otherwise the accident could have been much more serious.

Liability for the accident was accepted in March 2010; however it has taken until now for both parties to agree a settlement figure.

Motorbike accident claims can be very serious compared to other types of personal injury claims.
Freedom To Choose

After an accident, many bikers mistakenly think that they have to use a solicitor on the panel of their own insurers to make a personal injury claim.

This is not true - all bikers and accident victims have the freedom to choose their own personal injury lawyer.

Most bikers and road users have legal expenses insurance with their motor insurance policy. However that still does not mean that you have to use a panel solicitor appointed by the insurance company. Even if you don't have cover, most motorbike accident lawyers operate on a no win no fee basis which means there's nothing to pay win or lose and you keep 100% compensation.

Make sure you choose an independent lawyer who is specialist in motorbike accident claims.
Protective Clothing Can Save Serious Injuries In An Accident

Whether you are riding a moped, scooter or motorbike, it is extremely important to ensure you have the correct protective clothing to help prevent serious injuries in an accident. Not only will the correct protection help if you fall off, but the correct clothing will protect you from the weather and also helps your visibility to other road users.

Your safety helmet is the most important piece of safety kit and could save your life in an accident.

By law, you must wear a safety helmet when riding a motorcycle on the road. If your helmet gets damaged or takes an impact you should always buy a new one and never buy a second hand one as you can't always see if there has been previous damage. Plus, it is worth investing in a white or brightly coloured helmet as it may help you to be more visible to other road users.

Visors and goggles will help protect your eyes from the elements. You should not wear tinted goggles or visors if you are riding your motorbike in the dark or when there is poor visibility.

To help protect yourself from injuries and the weather, you should invest in good quality protective clothing, including a jacket, trousers, gloves and gantlets and boots. Also look for added protection on the shoulders, elbows and knees.

Unfortunately many motorbike accidents occur when other road users don't see you. For good visibility, clothing which is reflective in the dark and fluorescent during the day is recommended. You need to ensure you are visible from the side, back and front.

Helmets Not Just For Bikers

The Child Brain Injury Trust is calling for the law to be changed to make it mandatory for all children to wear helmets whilst cycling or skateboarding to help prevent serious brain injuries.

They are calling for parents and children to "play it safe this summer", highlighting the risks of brain injuries caused by accidents particularly in the summer months when skull fractures are expected to increase by 30%.

According to the charity, research shows that a helmet can play a key role in avoiding traumatic brain injury by absorbing up to 63 per cent of the impact, which could make all the difference between a mild or serious brain injury, or between life and death.

Lisa Turan from the charity explained: "...what IS surprising is the amount of children who set out for summer fun without wearing any protective head gear. Youngsters don't think about the risk of brain injury when they jump on their bikes or head to the skate park.
Why motorbike accident claims are seasonal

Many bikers believe that more motorbike accidents happen in winter due to poor weather conditions and poor visibility. However, more motorbike accident claims are made in the Spring and Summer months.

Statistics show that in general, there are more accident claims for both drivers and bikers and is attributed to a number of factors including the complacency of motorists in the summer months, coupled with increased traffic on the roads. Plus, many experts say that hot weather leads to fatigue, affecting both car drivers and motorcyclists. There is also a link with younger and newly qualified bikers who believe it is safer to adjust to riding in the warmer and dryer months.

Advice from the experts is clear - enjoy riding in the warmer months but if necessary brush up on your skills, make sure you continue to be vigilant of other road users and increased traffic, take plenty of breaks to prevent fatigue and ensure you have suitable safety equipment and clothing.

For motorbike compensation advice from experienced and specialist solicitors, call today on 0800 612 4479 or contact our road traffic accident lawyers online.

Motorcycle Safety Trial

A safety scheme trialed in Northumberland to reduce the number of motorbike accidents is being extended following its success.

The scheme used bright yellow signs on many rural roads that were accident hotspots which were designed to make bikers alert to the dangers of speeding and taking corners too fast.

The trial led to a decrease in the number of motorbike accidents where the signs were displayed.

Victoria Barrington, Head of public protection at the county council, commented: "The success of last year's pilot scheme indicates that these warning signs can have a positive impact on the behaviour of people who may otherwise drive dangerously."

Unfortunately, motorcyclists suffer far more serious injuries such as head injuries and spinal injuries after a road accident.
Research reveals human error in serious accidents

Research from the Institute of Advanced Motorists (IAM) shows that the top three causes of serious and fatal crashes point to driver and rider error.

The ‘Licensed To Skill: Contributory Factors In Accidents' report analyses five years worth of accident data.

Failing to look properly, loss of control and poor turning accounted for 65.3% of fatal accidents and 61.8% of serious accidents, whilst unwise or illegal judgments such as speeding or following too close were the second biggest factors. Behaviour or inexperience was the third contributory factor in 28% of accidents. Surprisingly vehicle defects, factors affecting vision and the road environment were listed in very few accidents.

IAM chief executive Simon Best said: "What is obvious from the top three rankings is that many accidents could be prevented by drivers simply changing their behaviour, as well as gaining more experience. That so many crashes are caused simply by the driver failing to look is shocking. On the positive side, there is plenty that drivers can do to reduce their risk of being involved in an accident."

Unfortunately, motorcyclists suffer far more serious accidents and injuries, in particular serious brain or spinal injuries.

If you have suffered injury after a motorbike accident it is vital that you choose solicitors who have not only the legal experience to help you with your motorcycle accident claim, but who also have the experience in organising a rehabilitation and care plan to help you on the road to recovery.
